Terms of participation Facebook - Sweepstakes

The Advent calendar Facebook competition is run by Amarella e.K., owner Sandra Schwarz, Hans-Thoma-Straße 20, 68163 Mannheim, Germany.

The competition starts on 01.12.2021 at 08.00 (CET) and ends on 24.12.2021 at 23.59 (CET).

The competition is not connected to Facebook, it is neither sponsored, supported nor organized by Facebook.

Various products, discounts, subscriptions, etc. will be raffled among all participants (hereinafter referred to as „participants“).

All natural persons over the age of 18 with a delivery address in Germany may participate, as free shipping is exclusively within Germany. Excluded are employees of Amarella e.K., owner Sandra Schwarz and all participating companies as well as their relatives. Participation with forged identities or in the name of third parties, e.g. through a lottery service, is excluded. Each participant can only participate once a day in the competition.

Eligible participants can participate in the lottery by being a "fan" of the official Amarella e.K., owner Sandra Schwarz, Facebook page, by linking to the lottery posting ("Like" click), commenting on the entry and leaving this rating until the winners have been selected. It is also required that the name of the winner is displayed by a link or as a comment below the winning entry. By participating, the Facebook user agrees to the terms and conditions.

Comments that violate Facebook guidelines, German law and/or copyright will be removed without prior notice. The participant is thus excluded from the prize.

A cash payment of the prizes is not possible.

The winners will be randomly selected from all eligible participants within one week of the closing date. The winners will be notified in writing (email or Facebook message) and requested to send an email to an email address specified there within 48 hours, in which the personal data will be transmitted in an orderly and truthful manner. This information will be used to send the prize.

If no e-mail is received by Amarella e.K., owner Sandra Schwarz, from a winner within the specified period, the claim to the prize expires. In this case Coffee Consulate, owner Steffen Schwarz, is entitled to carry out a substitute draw. By accepting the prize, the winner agrees that Amarella Trading e. K., owner Sandra Schwarz, may use his name for advertising purposes and may name the winner's Facebook name in a Facebook comment below the entry.

If the entrant uploads photos, videos or other media, the entrant warrants that the entrant will not submit any content whose provision, publication or use violates any applicable law or the rights of any third party. The participant guarantees to be the sole owner of the necessary rights to the uploaded or linked photos or videos. The participant releases Amarella e.K., owner Sandra Schwarz, from claims of third parties of any kind resulting from the illegality of photos used by the participant. The obligation to indemnify also includes the obligation to completely indemnify the organizer from legal defense costs (e.g. court and attorney fees).

The participant grants Amarella e.K., owner Sandra Schwarz, the following simple, temporally and spatially unlimited but non-exclusive rights of use to the photos, videos or other media used by him:

- the right to store the photo on a server;

- the right to edit the photo, without altering it.

Amarella e.K., owner Sandra Schwarz, will mark the author in a suitable way when using the picture, as far as this is appropriate considering the concrete form of use.

By participating in the competition, the participant releases Facebook from any liability.

If a participant violates the conditions of participation or gives incorrect information, Amarella e.K., owner Sandra Schwarz, can exclude him from participation without having to give reasons. Should individual provisions of these conditions of participation be or become invalid, inadmissible or unenforceable, this shall not affect the validity of the remaining conditions of participation. Any rights arising from the legal relationship on which these conditions of participation are based are not transferable to third parties for the participant. The law of the Federal Republic of Germany shall apply. Legal recourse is excluded.
